Consequently, a workers’ compensation company will most likely not be responsible for payment of lost wages (also known as indemnity benefits) if the injured worker seeks medical providers through his/her own automobile insurance coverage.
Another unique issue in a work comp/auto accident is the lien provisions of Florida Statute Section 440.39. This Statute allows the workers’ compensation insurance company to force reimbursement of the money that they have paid out for medical care and lost wages from any recovery by the injured worker in his/her automobile accident case. I have negotiated with workers’ compensation insurance companies on many, many occasions to reduce and at times waive (give up) their lien so that my client can obtain much more of the money from their automobile accident case.
